This Legal Notice explains who operates this website, the basic rules for using it, and how it relates to our other store policies. In this Legal Notice, "Oakmeregoods", "we", "us" and "our" refer to the operator of this store. "You" refers to anyone who visits or uses this website.

Oakmeregoods is an online home goods store. We sell lighting, clocks, decor, trays, vases, bath mats, towels, cushions and similar household items to customers in the United States.

2. Using this website

You may use this website to browse products, contact us and place orders for your own personal or household use. When using the website, you agree not to:

  • break any applicable law or use the website for fraudulent or unlawful purposes;
  • place orders using payment details you are not authorized to use, or provide false identity, billing or shipping information;
  • attempt to gain unauthorized access to the website, other users' accounts, or the systems that run the website;
  • introduce viruses, malicious code, or anything designed to disrupt, damage or overload the website;
  • use bots, scrapers or other automated tools to copy content or data from the website, except as permitted by our Terms of Service;
  • post or send content that is abusive, harassing, defamatory, obscene, misleading or that infringes someone else's rights.

You are responsible for the accuracy of the information you give us, including your name, email address, phone number, and billing and shipping addresses. We are not responsible for delays, failed deliveries or other problems caused by incorrect or incomplete information you provide. We may restrict or suspend access to the website, or cancel orders, where we reasonably believe these rules have been broken.

3. Products and product information

We aim to describe and show our products accurately. Product descriptions, dimensions, materials, colors and other specifications are based on information provided by our suppliers. Please keep in mind that:

  • Colors and finishes may look different on your screen than in person, depending on your device and settings.
  • Natural and handcrafted materials, such as stone, marble, travertine, wood and ceramic, vary in grain, veining, color and texture, so no two pieces are exactly alike.
  • Measurements and weights are approximate, and small variations can occur between production batches.
  • Product photos are for illustration. Styling items shown in photos (for example, other decor, plants or furniture) are not included unless the listing says so.
  • Suppliers may make minor changes to packaging, components or design details without notice.

Some lighting products may require installation, and some are hardwired fixtures. Always follow the instructions supplied with the product and applicable local electrical codes. For hardwired fixtures, we recommend installation by a licensed electrician.

If you receive an item that is materially different from its description, damaged or defective, please contact us as explained in our Refund Policy.

Products are shown subject to availability. We may discontinue products or change listings at any time.

4. Pricing and orders

All prices are shown in US dollars. Shipping costs and any applicable taxes are shown at checkout before you pay.

We work to keep prices and listings accurate, but mistakes can happen. If a product is listed at an incorrect price or with incorrect information, we may correct the error. If we discover the error after you have ordered, we will contact you and give you the option to continue at the correct price or cancel the order for a full refund.

Placing an order is an offer to buy. An order is accepted when we confirm it or ship it. We may decline or cancel an order, including after it has been placed, for example if:

  • the product is out of stock or no longer available from our supplier;
  • there was a pricing or listing error;
  • we cannot ship to the address provided;
  • the order appears fraudulent, suspicious or unauthorized, or fails payment verification; or
  • the order appears to be placed for resale, or exceeds reasonable quantity limits.

If we cancel an order you have already paid for, we will refund the amount paid for the cancelled items to your original payment method.

5. Payments

Payments are processed through Shopify's secure checkout and the third-party payment providers shown at checkout. Your payment is handled by those providers under their own terms and privacy policies. We do not see or store your full card number.

You confirm that you are authorized to use the payment method you provide and that your billing information is accurate and complete. We may need to verify payment or billing information before an order is shipped.

6. Intellectual property

The Oakmeregoods name and branding, and the original text, graphics, layout and design of this website, belong to us or are used with permission. Some product images and descriptions are supplied by our suppliers or other third parties and remain the property of their owners. Other names, logos and trademarks shown on this website, including Shopify's, belong to their respective owners.

You may view and print pages from this website for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute or use our content, including product photos and descriptions, for commercial purposes without our prior written permission.

7. Third-party services and links

We rely on third parties to run our store, including:

  • Shopify, which hosts this website and provides the checkout;
  • payment providers, which process payments;
  • suppliers and fulfillment partners, including partners located outside the United States, which produce, pack and ship many of our products directly to you; and
  • shipping carriers, which deliver orders.

These providers operate under their own terms and policies. Your purchase is made with Oakmeregoods, and we remain your point of contact for questions or problems with an order.

This website may contain links to third-party websites, such as social media platforms. We do not control those websites and are not responsible for their content, availability or privacy practices. Visiting them is at your own discretion.

8. Shipping and delivery

We currently ship to addresses in the United States only. Many items are shipped directly from our fulfillment partners, and orders with more than one item may arrive in separate packages. 9. Returns and refunds

Returns, refunds, and damaged, defective or incorrect items are covered by our Refund Policy. Please review it before making a purchase.

10. Disclaimer and limitation of liability

We work to keep this website accurate, available and secure, but we cannot guarantee that it will always be error-free, uninterrupted or free of harmful components. Information on the website is provided for general information and may change without notice.

To the extent permitted by law:

  • we are not liable for indirect, incidental or consequential losses, such as loss of profits, loss of data or business interruption, arising from your use of the website or products purchased from it; and
  • our total liability for any claim relating to a product is limited to the amount you paid for that product.

We are not responsible for loss or damage caused by misuse of a product, failure to follow the product's instructions, incorrect installation, normal wear and tear, or events outside our reasonable control.

Nothing in this Legal Notice limits or excludes any liability or consumer right that cannot be limited or excluded under applicable law. Some states do not allow certain limitations of liability or exclusions of implied warranties, so some of the above may not apply to you.

We may also update this Legal Notice from time to time, for example to reflect changes to our business or to legal requirements. The updated version will be posted on this page with a new "Last updated" date. Changes do not affect orders already accepted, unless required by law.

This Legal Notice and your use of this website are governed by the laws of the State of Oregon and applicable federal laws of the United States, without regard to conflict-of-law rules.
